FanHQ Terms of Service

These Terms of Service ("Terms") govern your use of FanHQ, including the website at www.fanhq.live and any related services (together, the "Service"). The Service is operated by FanHQ LLC ("FanHQ", "we", "us").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What FanHQ is

FanHQ lets fans support content creators by playing mobile games and completing offers provided by third-party partners. When a fan completes an eligible offer, the fan earns points and the supported creator may earn revenue. FanHQ also shows challenges, milestones, and leaderboards.

The Service is currently in a limited, invite-only pilot available only to users in the United States. We may add, change, limit, or remove any feature, game, or offer at any time.

2. Eligibility

To use the Service, you confirm that: - you are at least 18 years old, or the age of majority where you live if higher; - you live in, and use the Service from, the United States; - you can legally enter into these Terms; - the information you give us is true and accurate; - you are a real person using the Service for its intended purpose; - using the Service is lawful where you live, and you are not using a VPN, proxy, or other tool to disguise your location; - you are not located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, and you are not named on, or owned or controlled by anyone named on, a U.S. government sanctions or restricted-party list.

3. Accounts

  • You may hold only one account. Accounts are personal and may not be shared, sold, or transferred, and you may not create an account for someone else.
  • You sign in with Google or an emailed sign-in link. Keep access to that email account secure. You are responsible for all activity on your FanHQ account, and you must tell us promptly if you believe it has been accessed without permission.
  • During the pilot, access may be limited to invited users. We may approve or decline any account at our discretion.
  • You can ask us to delete your account at any time by emailing support@fanhq.live. We will handle your request as described in our Privacy Policy.

4. Offers and third-party games

  • Offers are supplied by third-party partners, such as offerwall providers and game publishers ("Partners"). When you install or play a game or app, you enter a separate relationship with that Partner. Its terms and privacy policy apply, not ours.
  • Offers are advertisements. Partners and advertisers pay for completions, and the offers you see may be personalized using information about you and your device, as described in our Privacy Policy.
  • Listing or promoting a game or offer does not mean we endorse its content. Questions about a game itself, including in-game purchases, ads, or content, should go to the Partner.
  • An offer counts only when the Partner confirms the required action (such as installing a game or reaching a level) was completed through FanHQ's tracking link, under the offer's stated conditions.
  • We rely on data from Partners. Confirmations can be delayed, incorrect, or reversed. If a Partner does not confirm a completion, or stops sending data, we cannot credit it. Partners decide whether a completion qualifies, and we cannot guarantee any offer will be credited.
  • Some offers are only for new players. If you have installed or played that game before, you may not qualify.
  • Offers may have limits, including a maximum number of points per game. Availability, requirements, and points vary by country, device, account, and other factors, even for the same activity.

5. Points

  • Points track your participation and your support for creators. Points have no cash value, are not money or property, cannot be purchased, and cannot be transferred, sold, or exchanged for anything.
  • Fans do not receive cash, gift cards, or any other reward for completing offers. Points exist to show your support for creators and your standing in challenges and leaderboards.
  • Points may show as "pending" until the Partner confirms the completion, and "approved" afterwards.
  • We decide how many points each offer, milestone, or challenge is worth, and we may change this at any time. Changes do not affect points already approved, except as described in Section 7.
  • We may remove or adjust points if a completion is reversed, found ineligible or fraudulent, or credited in error.
  • Leaderboard positions and challenge results are based on approved points and may change as completions are confirmed or reversed.
  • Attribution: a completion counts toward the creator you were supporting when you clicked the offer. If you switch creators, earlier completions stay with the original creator, and completions after the switch count toward the new one.
  • Points may expire if your account is inactive for 180 consecutive days, or when your account is closed.

6. Creators

These terms apply if you join FanHQ as a creator.

  • Approval. Creator accounts require our approval. We may suspend or remove a creator page at any time.
  • Earnings. Creators earn a share of the revenue FanHQ actually receives from Partners for approved completions attributed to their page. Your share and any fees are set out in your creator agreement or dashboard. Accruing earnings are estimates until confirmed and paid.
  • Reversals. If a Partner reverses, refuses to pay, or charges back a completion, we may deduct the related amount from your unpaid or future earnings.
  • Payouts. During the pilot, payout timing, minimums, and method are agreed individually with each creator in writing. You must provide accurate payout and tax information (such as a W-9 or W-8) before we can pay you. You are responsible for your own taxes.
  • Disclosure. Creators earn money when fans participate. When you promote FanHQ, challenges, or offers, you must clearly tell your audience that you earn from their participation, and follow applicable advertising laws and platform rules, including the U.S. FTC Endorsement Guides.
  • Honest promotion. Do not encourage fans to use fake accounts, multiple devices, VPNs, or any other method to inflate completions, and do not promise fans anything FanHQ does not offer. Completions driven by these practices are not eligible for earnings.
  • Independent contractor. Creators are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship. You may not make promises or commitments on FanHQ's behalf.
  • Your brand. You grant FanHQ a non-exclusive, royalty-free license to display your name, handle, image, and channel content on the Service and in materials promoting your creator page while your account is active.

7. Fraud and prohibited conduct

We expect honest participation. You must not: - create multiple accounts, or use someone else's account; - use VPNs, proxies, emulators, bots, scripts, device farms, reused device IDs, or any other method to fake, automate, or manipulate clicks, completions, or points; - make unusual or implausible game progress, or complete offers on behalf of others; - pay or incentivize others outside the Service to complete offers for your benefit; - exploit bugs, tracking errors, or attribution loopholes, instead of reporting them to us; - scrape, crawl, or use automated tools to access the Service; - reverse engineer, disrupt, or try to gain unauthorized access to the Service, or bypass its security features; - harass, threaten, impersonate, or abuse other users or creators; - post or share content that is unlawful, deceptive, hateful, sexually explicit, infringing, or harmful; - use the Service in violation of any law.

We and our Partners use automated systems, which may include machine learning, and manual review to detect fraud. If we reasonably believe you have broken these rules, we may, without prior notice, withhold, reverse, or cancel points and earnings, require the return of anything obtained through the violation, and suspend or close your account and any related accounts.

8. Your content

You keep ownership of content you submit, such as profile details or shoutouts. You grant FanHQ a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and use that content to operate and promote the Service. You confirm you have the rights needed to grant this license.

We may review, remove, or refuse to display any content at any time. We do not endorse content posted by users, and we are not responsible for it.

9. Our intellectual property

The Service, including its software, design, logos, and text, belongs to FanHQ or its licensors. We give you a personal, revocable, non-transferable license to use the Service as these Terms allow. You may not copy, modify, distribute, or create derivative works from the Service, or use "FanHQ" or our logos, without our written permission. Third-party game names and logos belong to their owners.

10. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account, or end the Service, at any time, including for a breach of these Terms or suspected fraud. On termination, pending or unapproved points and earnings may be forfeited. Confirmed creator earnings not linked to a breach or fraud will be paid out under Section 6. Sections that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, that any game or offer will be available or credited, or that any creator will earn any amount. We are not responsible for third-party games, offers, websites, or the conduct of other users.

12. Limitation of liability

To the fullest extent permitted by law, FanHQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you received from or paid to FanHQ in the 12 months before the claim, or (b) US $100.

Some jurisdictions do not allow some of these limits, so they may not fully apply to you.

13. Indemnity

You agree to defend and indemnify FanHQ and its officers, employees, and agents against claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your content, your dealings with other users, or your misuse of the Service.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any claim relating to the Service must be filed within one year after it arises, or it is permanently barred, to the extent the law allows.

15. Changes

We may update these Terms. If a change is material, we will notify you by email or through the Service before it takes effect. Continuing to use the Service after changes take effect means you accept them. If you do not agree, stop using the Service.

16. General

  • Electronic communications. You agree to receive notices and agreements from us electronically, including by email and through the Service.
  • Assignment. You may not transfer these Terms or your account. We may assign these Terms, for example in a merger or sale of our business.
  • Entire agreement. These Terms, the Privacy Policy, and any creator agreement are the entire agreement between you and FanHQ about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
